Terms and Conditions
(the not so small print!)
1. General Terms & Conditions:
- Additional costs incurred will be payable by the client.
- No additional travelling expenses will be incurred unless previously agreed.
- Where applicable David A will recover reasonable accommodation expenses and petrol if the ceremony or reception is 50 miles or more from base.
- It may occasionally be necessary to travel on the day before a wedding to avoid traffic and other problems and/or to stay overnight should a wedding run late. The client shall reimburse such cost.
- A reasonable supply of Food and drink should be available for the prhotographer where attendance exceeds 4 hrs.
2. Payment:
- The full wedding photography package cost depends entirely on the client’s precise requirements and will be have been discussed in detail prior to an invoice being raised.
- A deposit of 50% is payable at the time of booking, once cleared, David A will be the sole photographer and will work exclusively for your Wedding day.
- The deposit is non refundable other than in exceptional circumstances.
- The final balance for photographic services is payable no less than 7 days before the wedding date.
- Payments are non refundable except in exceptional circumstances.
- Payment for final album and/or print choices choice are payable upon proofing confirmation to David A;
- Non-payment of the final balance prior to the wedding date may constitute a breach of contract any previous contract will therefore be deemed null and void.
- All prices and packages are subject to change. Prices are adjusted periodically; An agreed price is guaranteed once a deposit payment is cleared..
- Returned cheques shall attract an additional £25.00 charge.
- David A cannot guarantee to reserve your chosen date until the deposit is paid.
- Carriage or postage charges may apply where necessary.
- Various proofing methods exist, these include a wedding memory box containing your complete collection of proofing photographs (subject to a £70 surcharge), Proofing by secure web page, or by personal CD. Additional proofing disks for other family members (CD-ROMs’) can be supplied for an additional charge of £15.00 per disk.
- Time spent photographing the wedding that exceeds the agreed attendance period will be charged at £50.00 per hour and invoiced to the client.
3. Exclusivity:
- David A shall be the exclusive photographer retained by client unless otherwise agreed in writing.
- Family and friends are encouraged to take their own photographs but you are asked to assist by ensuring that guests do not disturb or disrupt or interfere with the photographer’s duties.
- Bound by a duty of care to providing you with the best possible photographs David A may ask persons obstructing to refrain from doing so, in order to carry on his duties. It is advisable to inform guests of this before hand.
- Guests are not permitted to take photographs of poses arranged by the photographer. It is my duty to provide you with a unique service.
- Persistent breach of this agreement may constitute a reason for non-completion of the assignment with no liability remaining with the photographer.
- David A reserves the right to use any images for any form of advertising to promote their company including but not limited to Web based promotions, brochures, galleries, competitions. David A will not without your express permission use or allow to be used your likeness or any other pictures from your exclusive collection for any purpose other than self promotion or demonstration of ability.
4. Inherent Quality.
- Clients should be aware that colour dyes in photography may fade or discolour over time due to nature of photographic dyes and insufficient care and preservation of prints and albums.
- The photographer will not be held responsible for damage of albums and prints that were dispatched undamaged.
- The photographer will not be liable for degradation of images due to poor handling and insufficient care.
- All albums and images need to be kept at room temperature, stored in a box; away from heat and direct sunlight which will reduce the life of your images.
5. Unforeseen Problems
- If David A is unable to fulfil the role of wedding photographer on the day due to unforeseen circumstances (including but not limited to severe illness, death, death of family, serious injury or similar extenuating circumstances) liability shall be limited to a full re-fund although in such extreme circumstances David A will, where humanly possible, use his best endeavours to secure or provide an alternative photographer.
- This limitation shall also apply in the event that photographic materials are damaged, lost, stolen, camera malfunction or any other damage without fault of David A.
- In the event of client cancellation no refund shall be payable due to loss of business.
6. General
- David A cannot be held responsible for images and photography sessions being disrupted by adverse/unfavourable weather conditions or other unusual events.
- David A will not be deemed liable for any amount exceeding the retail value of your package.
- All re-orders shall be an extension of this contract.
- All re-orders must be paid for in full prior to orders being dispatched.
- David A will not be held responsible where reduced coverage results from interference or restriction by bride and groom, wedding party or guests being late or otherwise interfering with or restricting the photographer in performing his duties.
- David A will not be deemed responsible where restrictions imposed by church; reception, hotel or other venue prevents images being taken.
- Whilst working hard and using best efforts to produce the best possible record of your wedding the photographer cannot absolutely guarantee any specific image or incorporation of any specific background or specific group arrangement.
- The photographer will not be held responsible for customer disappointment of agreed album and images that are technically acceptable.
- Any announcements that will affect your photography and the day, such as timings or venue change or any other material changes should be notified as soon as possible in writing to David A.
- No circumstance that may or might detrimentally influence the success or otherwise of your wedding photography will be deemed the responsibility of David A where such circumstance is not bought to his attention or is beyond his control.
- To prevent late arrival a map and or detailed directions should be provided if necessary. Where a venue is in a location that might reasonably be described as remote or obscure it is advisable for a designated guide to accompany or lead the photographer.
- Contact details of all venues should be provided. David A will not be responsible in the event that such information is incomplete or inaccurate.
- Due to the technical procedures of image processing, David A cannot guarantee exact colour matching.
- Any digital cosmetic enhancements (such as airbrishing of spots, cold sores etc.) shall require written authorisation and shall be subject to client aproval and authorisation before printing.
- David A will not be deemed be responsible for print selection errors whether re-prints or album prints.
- David A will not be responsible for any damage to CD-ROMs provided, appropriate care is the responsibility of the client.
- David A accepts no responsibility for the reliability of any postal service. This includes the physical condition of any materials that may be sent by mail. A courier service can be arranged the cost of which shall be met by the client.
- Clients are advised that there may be slight variations in colour from proofing to final completed images. Under no circumstances can we guarantee that the colour of the proofs supplied and the colour of the final images will match exactly. This is usually because final images undergo a higher standard of preparation than proof images and are more likely to represent a more accurate reproduction of the original.
- All of the above agreements apply to all of our work and albums.
